Social Security Disability Benefits

When is a Person Eligible for Social Security Disability Benefits?

This program was designed for individuals who have worked long enough, usually 10 years or more, and have earned enough credits to qualify for Social Security Disability Insurance.

Besides earning enough credits, to be considered disabled, individuals must also have an impairment or a combination of impairments, either physical or mental in nature, which keeps them from working. In addition, the disabled person’s impairment(s) must be considered chronic in nature, thus it must have lasted, or is expected to last, at least 12 consecutive months.

What Does "Disability" Mean When Proving Your Case?

When it comes to Social Security disability benefits, in order for an individual to be considered “disabled”, the Social Security Administration analyzes your claim using what is called the Five Step Sequential Evaluation Process. The sequential evaluation process is series of five “steps” that Social Security follows in a set order to decide a claim. If it can find that you are disabled at a step, Social Security makes its decision and it does not move to the next step. If Social Security cannot find that you are disabled at a step, then it moves on to the next step until you are found either disabled or not at the last step. The five step process is very complicated and confusing hence the need for an experienced Social Security Attorney who is familiar with the rules and regulations.
